This is clearly leaving open the door for the DOJ (Justice Department) to appeal, if Turner is run separately, they don't really need a stay.

Given the number of industry participants, a merger which combines a 5-percent market share participant doesn't seem to me to raise significant antitrust concerns.

Clearly it does raise competition questions, given the leadership role of these two companies in the chemical industry.
