This is not over. We will be asking the federal appeals court to expedite the ongoing appeals proceeding to halt the irreversible and imminent damage from Trump's border wall. Border communities, the environment, and our Constitution's separation of powers will be permanently harmed should Trump get away with pillaging military funds for a xenophobic border wall Congress denied.

The Constitution assigns Congress the power of the purse, and no prior president has ever tried to use emergency powers to fund a chosen project -- particularly a permanent, large-scale domestic project such as this -- against congressional will. This is obviously improper.

This decision is troubling, it leaves the parties in the dark, and denies the public any understanding of why the government is denying someone his day in court.

It's a good start that the Biden administration is not rushing to defend Trump's illegal wall in court, but just hitting the brakes isn't enough. Trump's wall devastated border communities, the environment, and tribal sites, it's time for the Biden administration to step up for border communities, and commit to mitigating environmental damage and tearing down the wall.

The Trump administration has lost in every lower court, but is still rushing to complete the President's border wall before The Supreme Court can review the merits of this case, if the administration succeeds, there will be no border wall construction left to stop by the time The Supreme Court hears this case.

President Trump's xenophobic wall is already leveling protected lands, desecrating cultural sites, and destroying wildlife, there's no undoing the damage that's been done, but we will be back before The Supreme Court to finally put a stop to this destructive wall.
