The amount of litigation that we have seen in this election is staggering, what I think is shocking -- and voters would be surprised to learn -- is how much of that litigation has been by campaigns to try and limit voter access, in some cases hauling election administrators into court because they are trying to provide good customer service to their voters in a time of a once-in-a-century pandemic.

We can't underestimate Justice Ginsburg role, justice Ginsburg had a way of writing Justice Ginsburg decisions so that they performed an active civic education. Justice Ginsburg was able to explain things in a way that people understood.

Americans and journalists need to be prepared for the fact that we may not know on election day who won.

Some, especially those in the beltway, may be viewing this through a partisan lens, outside of the beltway there are a lot of acknowledgment that states already have mail balloting systems and that's one of the ways we are going to keep Americans safe.

Given the consequences – someone's vote being lost, the system not fairly representing the voices in this country – we should be planning in a very risk-averse way.
